Terms and Conditions of Sale
1. Introduction and Scope
These Terms and Conditions of Sale (hereinafter "T&Cs") govern all sales of used vehicles concluded via the website https://autoparkbb.com between Automobilzentrum Hall (hereinafter "the Seller") and any professional or individual buyer (hereinafter "the Customer").
By placing an order on this website, the Customer unreservedly accepts these T&Cs. These conditions prevail over any other general or specific conditions not expressly approved by the Seller.
2. Vehicle Information and Availability
The vehicles offered for sale are used vehicles. The Seller provides a detailed description of each vehicle, including technical specifications, mileage, and a 360° visual report showcasing the general condition and any identified imperfections.
Availability is updated in real-time. However, a vehicle might be sold simultaneously via another sales channel or reserved by another customer. In such cases, the Seller will inform the Customer as soon as possible.
3. Ordering Process and Formation of Contract
The contract is formed through the following steps:
- Vehicle Selection: The Customer selects a vehicle and chooses the delivery and payment options.
- Order Validation: The Customer reviews the order summary and confirms their acceptance of these T&Cs.
- Confirmation: The sale becomes firm once the Seller sends a confirmation email and receive the down-payment or full payment as stipulated in the order.
4. Prices and Payment Methods
All prices are displayed in Euros and include all taxes (TTC), except for specific export situations. Prices include the costs of reconditioning and inspection.
Payments are made exclusively via:
- Bank Transfer: All payments must be made to the Seller’s secure bank account provided during the checkout process. We do not accept cash, checks, or credit card payments for vehicle purchases.
Ownership of the vehicle remains with the Seller until full payment of the purchase price is received.
5. Delivery and Transport
Automobilzentrum Hall offers worldwide delivery services. Delivery options include:
- Home Delivery: The vehicle is delivered directly to the Customer's address by a professional carrier.
- Partner Branches: The Customer can choose to pick up the vehicle at an authorized Automobilzentrum Hall center or partner pickup station.
Delivery times are estimated at the time of order and depend on the vehicle's location and the destination country. The Seller is not liable for delays caused by force majeure or third-party carriers.
6. Right of Withdrawal ("Satisfaction Guarantee")
The Customer benefits from a 14-day right of withdrawal from the day of delivery, in accordance with European consumer laws. Automobilzentrum Hall often extends this to 21 days (or up to 500km driven) as part of our specific satisfaction guarantee.
To exercise this right, the vehicle must be in the same condition as when delivered. Return costs are the responsibility of the Customer unless otherwise stated in a specific promotion.
7. Legal and Commercial Warranties
All vehicles sold by Automobilzentrum Hall come with a minimum 12-month mechanical warranty. This warranty covers major components as defined in the warranty certificate provided at the time of delivery.
This is in addition to the legal warranty against hidden defects (vices cachés) and the legal warranty of conformity provided by the laws of the country of sale.
8. Liabilities and Force Majeure
The Seller’s liability is limited to the purchase price of the vehicle. The Seller shall not be held responsible for indirect damages, loss of business, or any costs incurred due to the unavailability of the vehicle.
9. Governing Law and Disputes
These T&Cs are governed by the laws of the country where the Seller's main headquarters is registered. In case of a dispute, we encourage Customers to contact our customer service first for an amicable resolution. If no agreement is reached, the competent courts of the Seller's registered office will have jurisdiction.
